Terms and Conditions

These Terms and Conditions govern the use of Femuro Management Agency’s website, services, and property management operations. By engaging our services, accessing our website, or entering into any agreement facilitated by Femuro Management Agency, you agree to be bound by these Terms and Conditions.

1. About Femuro Management Agency

Femuro Management Agency operates under Femuro Enterprises Limited, a registered company in Kenya, and provides professional real estate and property management services, including but not limited to:

  • Property management
  • Rent collection and remittance
  • Property marketing and listings
  • Tenant placement and management
  • Survey coordination and property support services

2. Scope of Services

Femuro Management Agency acts as an agent on behalf of property owners (landlords). Our role includes managing day-to-day property operations as agreed in written contracts, but does not transfer ownership rights of any property to the agency.

Specific services are governed by:

  • Signed Property Management Agreements with landlords
  • Signed Lease or Tenancy Agreements with tenants

3. Landlord Terms

3.1 Appointment of Agent

By engaging Femuro Management Agency, the landlord authorizes the agency to manage the property in accordance with the signed management agreement.

3.2 Rent Collection & Remittance

  • Rent is collected through Femuro Enterprises Limited’s designated bank or payment channels
  • Rent is remitted to the landlord on the 10th day of each month, unless otherwise agreed
  • Tenant deposits are held by the agency and managed in accordance with tenancy terms

3.3 Agent’s Commission

Femuro Management Agency earns a 10% commission on monthly rent collected unless otherwise agreed in writing.

3.4 Maintenance & Repairs

  • The landlord is responsible for structural and general maintenance costs, excluding tenant-caused damage
  • The agency coordinates repairs and communicates required work to the landlord
  • A cleanliness or service charge may apply as agreed

3.5 Access to Property

The Landlord has unlimited access to the apartments, rooms or shops which the Tenants occupy and if necessary can so enter for purposes of inspecting the occupied premises after giving a 24 hours’ notice to the Agent and the Tenant.

3.6 Termination

Either party may terminate the management agreement in accordance with the notice periods set out in the signed contract.

4. Tenant Terms

4.1 Rent Payment

  • Rent is due on or before the 7th day of each month
  • Late payments may attract penalties as outlined in the tenancy agreement
  • Rent must be paid through the approved bank or mobile payment channels

4.2 Deposits

  • Security deposits may not be used as rent
  • Deposits are applied to repair damages (if any) upon vacating
  • Any balance is refunded after inspection, subject to the tenancy terms

4.3 Use of the Property

Tenants shall:

  • Not make structural alterations without written consent
  • Not sublet or transfer tenancy without approval
  • Maintain peaceful coexistence with neighbors
  • Use the property for lawful purposes only

4.4 Notice to Vacate

  • A one-month written notice is required before vacating
  • Failure to give notice may result in forfeiture of the deposit, as per the lease agreement

4.5 Breach & Eviction

In the event of persistent breach of tenancy terms, Femuro Management Agency may take lawful steps, including termination of tenancy, strictly in accordance with Kenyan law.

5. Evictions & Dispute Handling

Femuro Management Agency:

  • Handles eviction processes lawfully and humanely
  • Ensures compliance with applicable housing and tenancy laws
  • Encourages amicable resolution before legal escalation

Landlords remain responsible for post-eviction renovations or reinstatement works unless otherwise agreed.

6. Limitation of Liability

Femuro Management Agency shall not be liable for:

  • Losses caused by tenant default beyond reasonable control
  • Acts of third parties
  • Force majeure events (fire, floods, natural disasters, government actions)

Liability is limited to the scope of services expressly agreed in writing.

7. Intellectual Property

All website content, branding, text, images, and marketing materials belong to Femuro Management Agency unless otherwise stated. Unauthorized use is prohibited.

8. Privacy & Data Protection

Personal data is collected and processed in accordance with the Kenya Data Protection Act, 2019. Please refer to our Privacy Policy for full details.

9. Amendments

Femuro Management Agency reserves the right to amend these Terms and Conditions at any time. Updates will be published on this page with a revised effective date.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the Laws of the Republic of Kenya.

Important Note

These Terms and Conditions do not replace signed landlord or tenant agreements. In the event of a conflict, the signed contract shall prevail.
